Dutrow receives indefinite stay of suspension

Trainer Richard Dutrow Jr. on Wednesday received a stay of a 10-year suspension handed down last month by the New York State Racing and Wagering Board that will likely remain in force until his appeal of the board's decision is resolved.

New York Supreme Court Judge Richard Giardino granted the stay after Dutrow's attorney, Michael Koenig, submitted paperwork to the court challenging the 10-year ban. Dutrow had earlier received a 30-day stay of the ban after his attorney informed the court that he intended to appeal the board's decision. The 30-day stay was set to expire on Wednesday.

The stay will allow Dutrow to train while his appeal remains unresolved. In similar cases, appeals have taken at least six months to be resolved, and they usually stretch beyond 12 months.

"We're looking forward to challenging the board's decision and presenting our case," said Koenig, shortly after returning from the court.

Technically, the stay was extended until Monday, in order to give the state time to prepare a request to move the appeal to the state's appellate court, which, in New York, is higher than the Supreme Court. The stay granted by Giardino on Wednesday contains language that will extend the stay on Monday until the appeal is resolved.

The New York racing board handed down the 10-year ban on Oct. 12, effective Oct. 18, citing Dutrow's long history of violations and calling his participation in the sport "inconsistent with the best interests of racing."

The bridgejumper in the first at the Big A was thinking the same thing about Rail Trip.  
Anybody know how much was in the show pool on this horse?

Last I saw (after Ramon got dumped), roughly $20K out of a $25K show pool.

Update: Rail Trip had $25,458 out of the $31,853 in the show pool. Final, I think.

Charles Hayward: For once do something that shows you take your position at NYRA
seriously: Pull Tricky\'s stalls. You can do this, and I do not think this can be
challenged in court. TDD\'s legal team could tie this ten year suspension up for
what? 3 years? 4 years?

JB: Could you publish the sheet for the Tricky runner Associate, now 2/2 off the
claim from Linda Rice? Could do no better than a TG 92  for Linda, ran
a TG NEGATIVE 2 something first off the claim, came back second off
the claim with an incredibly easy win under a Ramon hammerlock, running 7f in 22
and change on a day the track did not seem particularly fast.

As it happens I made essentially the same suggestion face to face with Hayward a couple of years ago, not specifically about Dutrow but as a solution in general. Florida did it with Ziade a few years ago, others did it with Gill.

Tricky been yakking to a few of his regular owners that he will be going to GP with a string and keeping another string in NY.Have to assume that GP has changed it\'s mind and will allow him to race, they do not have to.

Upstate political stooges that went after Tricky looking rather foolish now with this PR exercise to deflect attention from how poorly they have managed NY racing. NYRA in a bind to ban him having stated previously they would go along with courts which granted stay until the case is heard.Tricky in perfect position to be framed now but I\'m sure he\'s oblivious,babe.

Rumors of IEAH\'s demise, 6-12 months ago,were premature.Iavarone trying to save his creation, looking for new capital investment.IEAH Equine hospital busted out and closed, many of their expensive mares/runners unseen,Big Brown babies not looking great initially,lawsuits impending.IEAH seems a ticking time bomb.

Slots at Big A going great guns initially and NYRA gets a huge windfall and saved AGAIN by external forces. Guess it will be same old lack of transparency/bold initiatives at NYRA but with a fresh coat of paint.
