Derby Day ADW Meltdown. Where are the regulators?

I know this is a ThoroGraph board, but I need to vent:

On Derby Day, my Dad was betting online through his Del Mar Bets powered by XpressBet account.  He tried to bet Race 8, but got no message his bet was accepted, and eventually the betting window timed out.  I got his bet down through NYRA.  Thinking the problem might have been caused by betting too close to post time for Race 8, he tried betting an exacta box for the Derby, but met with the same fate, and again I bet for him through NYRA.  He then gave up on Del Mar Bets, we made the remainder of his bets through NYRA.  Long after the races had been run, the bets he had been unable to complete showed up in his account.  We called XpressBet to complain, and they took his information and promised to get back to him.  They never did.

I know there was a network failure, but stuff happens, and the ADW\'s should be prepared to deal with it.  Maybe a message about the problem on the home page or in a pop-up window when a customer tries to make a bet.  XpressBet\'s response was to apologize for the problem two days later, and keep my Dad\'s money.

I\'m curious if others had similar experiences.  In my mind, a contract requires both offer and communication of acceptance.  In this case the latter was lacking, and there is no basis for XpressBet deducting my Dad\'s wagers from his account.  Yet, based on this and prior experiences, it seems like these ADW\'s can make up their own rules as they go along.  Shouldn\'t the CHRB and other state regulators that license these ADW\'s make some rules and enforce them?

You could not be more correct but again the voiceless player is at the mercy of the clueless who run and operate the game.Regulators have little interest in the small, niche horseplayer getting screwed. Not enough votes!
