Look at Miff\'s first post in this string.  The stewards said the foul did not change the order of finish.

Just noticed this at the bottom of the chart for the race:

HAVING RECEIVED A PROTEST FROM THE TRAINER OF HORSE CLIFTON PLEASURE WHO FINISHED 2ND, FOR THE NON- DISQUALIFICATION OF YAKOV, BOTH HORSES ARE DECLARED WINNERS UNTIL THE MATTER IS ADJUDICATED BY THE NEW YORK STATE GAMING COMMISSION.

Yes just saw this. What happens to purse money? If issue is not quickly
resolved, will both horses be weight penalized in their next start? If my
horse was weight penalized but no purse had as of yet been distributed, I
definitely would be calling former agent/media personality/racetrack barrister
Drew Mollica to address this inequity.

Thank you for the response.  You could be right. I will need to look at the replay again.  However, my recollection was that Desormeaux\'s horse was on the rail (or close to it) and came 5 or 6 paths wide to engage the horse running on the crown.  My recollection (which could be faulty) was that the horse on the crown was bracing/preparing for the contact that was coming.  While that may have looked like initiative, it seems somewhat justified with Desormeaux\'s horse making such a starkly sharply aggressive move towards him.  Is a horse supposed to check and give up the path because somebody comes straight for him?  Remember also the difference between slo mo and real time and a huge horse clearly coming out with mal-intent.  Anyway, I do not think there was any question that even if the 7 horse defensively initiated the contact, Desormeaux\'s horse definitely pushed back and there can\'t be reasonable argument about which horse got the worst of it.  Now, I agree that the 7 was not likely to beat Desormeaux\'s horse, but I find it hard to believe that he would have been caught for the DH for place if he had not had that trouble.

someone has got to explain to me why Yakov should have been Taking dowm , He never touched clifton pleasure , Yakov was drifting to the right but so was cliftons pleasure and ortiz was whipping to the left , I did bet Yakov and when I saw the replay there was never a doubt in my mind that he was stayin up.My Beef today is I hit the Pik 5at the Big A  Prices were $5.80 ,$20.60 ,$ 3.80, $12.80 ,and 35$ and it only paid $3300 for .5  But that shouda been  alot more

Didn\'t it happen once that the stewards DQ\'ed the wrong horse at Saratoga and they were exiled to Finger Lakes?  Maybe 20 years or more ago.
