Derby Wars suit

As we discussed before on fantasy football, Derby Wars being sued by Stronach, looks like the beginning of the end for this too.

Breakage

Stronach does not own the results.

This has already been tried twice and twice the courts ruled that the results are news and therefore public property.

MLB was this:
 Baseball and its players have no right to prevent the use of names and playing records, U.S. District Court Judge Mary Ann Medler in St. Louis ruled in a 49-page summary judgment.

 St. Louis-based CBC Distribution and Marketing Inc. filed a lawsuit against Major League Baseball Advanced Media, MLB\'s Internet wing, after CBC was denied a new licensing agreement with the baseball players\' association giving it the rights to player
 profiles and statistics.

nfl:
 Yahoo has filed a lawsuit against the National Football League demanding access to player stats without having to pay licensing fees. Yahoo argues that player names, bios, and game statistics are not copyrightable information owned by the NFL, and that third parties should be able to make use of it for fantasy football leagues. Given a 2007 ruling on the same topic for Major League Baseball, there\'s a good chance that Yahoo will end up taking home the win.

 and they actually beat the NFL in a court room.

I\'ve been railing for years elsewhere of the NTRA Dodge the Take Out contest tour.(ironically they use the same excuse that derbywars did-contests bring new people into the sport=yea right)

I have been a avid horse player that tried to make money at it for years but as i got older I found much better ways to gamble that had lower take out so I would only play horses when I was actually at Del Mar during the live races or breeders cup\\ derby day.  When i discovered Derbywars about a year ago it got my horse race juices flowing again and i now handicap almost everyday again and everyday i still put a few of my best bets into the pools. My handle into the pools is around 50k more this year then any of the previous 5 years as a direct result of Fantasy horse racing. If they ban Fantasy horse racing it will be the last straw for me

Never sure myself how they get away with it, other than, until someone objects, you can get away with just about anything.

Do not think the DW concept is in danger. DW might have to pay racetracks; DW
might partner with racetracks, or DW might be purchased by a Stronach like
entity, but my opinion is that the availability of contests such as this will
not be interrupted...

...but remember it was also my opinion that TVG was not in Racing for the long
haul, an opinion I posted about 2 days before it was announced that TVG purchased
HRTV.

Still waiting for a horse racing game based on DFS where one \"buys\" or \"claims\"
a stable for a days races, winner determined not by pari-mutuel results but
rather by purse moneys earned.

Fine idea, especially for big race days, but possibly better-suited for private parties than for broad commercial consumption . . .

Hopefully if the tracks get a piece of DW they dont raise the rake. This industry probably will mess it up somehow
