The racing commission agreed to allow the remainder of the original blood sample to be tested for other ingredients found in the Otomax ointment but not in the injection.

However, according to the complaint, on June 1 the “KHRC informed the Plaintiffs that the ‘remnant’ samples had been damaged/contaminated during transport to the agreed-upon testing lab. This has created doubt over whether those samples will be sufficient to allow Plaintiffs to test them for the compounds in Otomax to prove the betamethasone in Medina Spirit did not come from an injection.”

The racing commission, according to the complaint, has refused to allow the urine samples to be used instead,” according to the suit. “Time is of the essence as biologic samples degrade with each passing day. Without intervention from this Court, Plaintiffs will forever lose the opportunity to test, analyze and cross-examine the only evidence that purports to establish a violation of the KHRC’s regulations â€" Medina Spirit’s biological urine sample that was split from the primary sample following the race.”

Amazingly, Baffert continues to dig the hole deeper. I have said this before. This Baffert saga will be a college Communications course in PR Strategy -- What Not To Do.

He meets the press arrogantly after the first positive -- a disaster. He sends his attorney to meet with CNN after the second positive -- a disaster. Now he demands the split sample to be further analyzed in an attempt to conclude the twice tested positive on a race day banned substance was from a topical treatment and not an injection -- as if that matters and it doesn\'t.

For the good of the sport Baffert should just go away. Narcissists can\'t just go away. I love the sport as an owner and fan and bettor. His behavior disgusts me.

I’m not a lawyer but I think this is a good strategy. The KHRC admitted they messed up handling the blood sample and the split urine sample is degrading every day. He’s whittling away. It’s more than I thought he could do.
