Derby win? NOT YET.

Top Rated Employer? HE DOESN\'T CARE!  Pay \'em as little as possible to make as much as possible as company owner.  I\'m the BOSS!  America is a great country INDEED!!  

Uncle Bill once theorized in the backyard if a trainer can get his horses to extend their stride by just an extra few inches in each stride, imagine the amount of distance that would cover in a race compared to another trainer who couldn\'t accomplish that.  I told UB he was crazy.  After further thought I actually gave it much more consideration...and I\'m still pondering that one.  

In the same vein, imagine the amount of money you could accumulate if you paid your workers with tips on turf winners when you have 3 in the race instead of overtime wages.....

I would want to know more before I convict here.

I assume a thoroughbred, make that any horse racing trainer, wants to get as much mileage out of a dollar as possible.

Being naive here I suppose that back stretch workers are some of the lowest paid personnel in the country. Offering them a room, board and daily, weekly or monthly wage package doesn\'t seem criminal.

Should the IRS consider it wrong that workers may start work @ dawn, stop during the race card and resume in the evening and not punch time cards and consider a fixed price wage not a salary.  The expense reimbursement is even more curious. Where a training track, or farm or ?? to not be the office.

So I need more information to convict.

It\'s hard to know where to start ....

First, you understand, don\'t you, that the concept of \"conviction\" was passed fifty miles ago as what happened is that Chad Brown has ADMITTED to the offenses described in the consent decree? Whether or not the facts alleged are true has already been settled.

Your reference to room and board and wage packages have nothing to do with the issues.  If Chad Brown is going to have employees, he has to comply with federal and state law like any other employer, which means (among other things) paying employees a minimum wage and paying overtime.  He has admitted he did not do that, to a large number of employees.  If he is going to hire employees under the H-2B program, he is going to have to comply with the terms of that program, like any other employer.  As the complaint alleged regarding the H-2B failures: He collected payment from employees for visa costs, which should have been paid by him.  He failed to reimburse employees\' transportation and subsistence costs for travel from their home countries.  He misrepresented to employees the place of employment and job terms and conditions, such as the availability of free housing.  And last but not least, he failed to disclose required information in a language understood by the employees.

Your narrative suggests that what you think was offered to employees \"doesn\'t seem criminal.\" Chad clearly knew what he was doing was wrong as he engaged in a pattern (again, acknowledged in the consent decree) of widespread falsification of time records.  Further, as the complaint alleged, Brown had already been cited in 2010 by New York State for his failure to maintain adequate time records, so he could hardly plead ignorance of his obligations under federal and state law regarding record-keeping.

The facts that Brown has acknowledged tell a sorry tale of a greedy employer taking advantage of low-skilled, vulnerable workers and doing everything he could to conceal his wrongdoing.  He should get no quarter from anyone on this board.

Reminds me of that guy a few years back who would ask every so often “is Chad Brown a nice guy?”

The hard hitting article from the Daily Racing Form with interviews of backside workers, Brown ownership connections, other trainers, Chad\'s quotes and investigating this issue to the fullest is a terrific piece by its New York correspondent.  They posted it very quickly.

Both the complaint and consent judgment can be found by going to US Department of Labor website and typing in Chad Brown or googling \"US Department of Labor Chad Brown complaint\". I would have been pleased to do it but that would assume I can figure out how to cut and paste those documents. I suggest that the documents portray a tad more than confusion and bookkeeping issues and Chad has to hire an experienced all monitor for the next there years. Any bets as to NYRA\'s reaction?
