Back in the 1980s CD refused to let the NYS OTBs take bets on the Derby. In fact, last year there was a problem between OTB & Churchill and it took a last minute settlement for NYS OTBs to get Churchill. If the track doesn\'t let you take bets, you can\'t take bets, pretty simple. I don\'t see how DRF has a leg to stand on.
The DRF site backends into Xpressbet, who most definitely took the Derby, and who CD is not suing. No idea what\'s going on here.
