Yet another genius has posted on the Rag site about my efforts to get what I am entitled to for the betting venture I put together. For the record, we settled with one of the three individuals (he agreed to pay us our share of anything he made), withdrew the suit against one of the others WITHOUT prejudice, and are in the process of doing so with the other guy. The reason for that is that it turned out they had made virtually nothing on their own so far, so I would have been spending 50k to chase far less. By withdrawing without prejudice we are retaining the right to sue them later.
The first court date was today, and a lot of this has been dealt with already. As for their sanctions motion, anyone who wants to can get a pretty good price from me on the question of its success.
See? You made assumptions about the sides of the house you couldn\'t see.
Raz (of course) and Chem--
SOMEBODY is spinning, all right. Ask your buddies how much they made betting, and post the answer. Then we\'ll have a conversation. Their lawyer said yesterday, in response to a question from the court, that the amount was very small. Hence my reluctance to spend far more than that to chase them.
As for the settlement with the other guy-- he finally agreed to give us the same affidavit and agreement to pay that we had been demanding right along, but had to sue him to get.
You should know better than to read filings that just represent one side of a house (whoops, I meant case), and think they tell the whole story. Presenting clients cases in the most rosy terms is what lawyers do for a living.
Hmmm... wonder what Chem\'s real name is...
And there they go again on the Rag board, making assumptions...
Yes, OPM knows the principals-- HE IS ONE. He\'s a partner in the betting venture with the guys I brought suit against. A point he and those guys have somehow neglected to mention, although they tried to use selected excerpts of an e-mail exchange he had with me against me in their sanctions motion.
But he also knows the PRINCIPLES. In one of the e-mails he sent me, talking about the behavior of his partners, he said \"I KNOW IT\'S UNFAIR TO YOU\", which somehow his partner\'s lawyers forgot to put into their motion. He went on to try to convince me that despite that, it wouldn\'t be worth my while as a practical matter to pursue things, which turned out to be correct, at least for now, since they have made virtually nothing betting. Which is why we withrew the suit.
