A federal District Court judge sitting in New York ruled on Wednesday that the New York Racing Association’s ban of the trainer Bob Baffert should be stayed, stating that the trainer’s rights to due process had been violated.

As much as as I hate what Baffert has done to the game, Judge Almon’s decision is absolutely correct as a matter of law.. The key is that Judge Almon found ( correctly in my view)NYRAs relationship with New York State is such that it’s actions are deemed state actions requiring due process, i.e. a hearing. Judge also recognized that money damages would be hard to calculate and coupled with a claim of lost opportunity- there is only one Saratoga meet-there would be irreparable harm to Baffert. FWIW- for reasons not clear to me - NYRA rushed this suspension and will not appeal.
However, Judge Amon did write that she believed that NYRA may have the ultimate authority to exclude Baffert, as long as the association took the steps to afford him his due-process rights. Attorneys for NYRA told Amon during the hearing this week that they planned to issue a decision on the length and terms of the ban after a meeting on Aug. 11.
“In sum, it is not likely that Baffert will be able to prevail on his claim that NYRA had no legal authority to take the action that it did,†Judge Amon wrote.
This one was pretty obvious.
Simple solution. Boycott the Baffert races. As a side note there are other chemists out there that are just as bad and I am finding it difficult to navigate the card for races where they don’t have entries.
